THE PROVISION OF PROFESSIONAL SERVICE PROVIDERS FOR THE EASE OF DOING BUSINESS AT THE SALDANHA BAY IDZ

1. BACKGROUND

The Saldanha Bay IDZ Licencing Company SOC Ltd (SBIDZ-LC) is a schedule 3D Provincial Government Business Enterprise. On 31 October 2013, it was formally awarded an Operator’s Licence, which enabled it to operate, develop and manage the Freeport Saldanha. This marked the formal beginning of a 30-year journey to create a vibrant hub of opportunity, job creation and sustainable growth utilising the Special Economic Zone (SEZ) legislation as a catalyst.

Freeport Saldanha is the first SEZ to be located within a port, catering to the oil and gas, maritime fabrication, repair and energy industries and related support services. The core function of the Ease of Doing Business (EODB) unit within Freeport Saldanha-LC is to make investment in Freeport Saldanha easier and to provide catalytic project support to our investors within the zone. To this end, Freeport Saldanha-LC requires the expertise of specialist service providers to assist our investors with SEZ– and business-related queries. The specialists would be part of a panel of preferred service providers on the EODB database.

2. PURPOSE

The purpose of this Terms of Reference (TOR) is to develop a database of specialised consultants that can assist Freeport Saldanha-LC’s investors with further EODB business-related matters within the SEZ sphere. These consultants offer services in areas, such as tax consulting, labour law, transport consulting and immigration.
The assistance required by the investors would primarily involve advising on the best options available to them based on their business and project setup, as well as assisting with the applications. Often, the requests are based on accessing the available SEZ and other incentives, as well as compliance matters related to labour and abnormal load transportation to visas and work permits.
Freeport Saldanha has identified an initial list of companies and persons to contact, however, this will be an ongoing process until 2023 to ascertain interest and good working practices between the SBIDZ-LC, the investors and the professional service providers.

The application link will also be available on Freeport Saldanha website and social media pages.

3. OBJECTIVES

3.1 To provide the required business-related assistance to the investors of Freeport Saldanha-LC.

3.2 To grow a reliable panel of service providers that extends the vision of Freeport Saldanha-LC with regards to a customer-centric zone that offers the EODB.

4. ELIGIBILITY REQUIREMENTS

4.1 The EODB unit requires the assistance of service providers to provide their services to Freeport Saldanha investors.

For the applicants to become part of the panel of service providers, they will be evaluated against the following criteria:

a) Area of specialisation and typical services offered (include company profile or brochure).
b) Years of experience.

c) Size of organisation.

5. IMPORTANT INFORMATION

5.1 The panel of service providers will only be selected via the application platform.
5.2 Freeport Saldanha-LC does not make the selection of the service provider on behalf of the investor. Our role is to share the information per category of service providers for potential investors / business partners to engage directly with the service provider on what services are required and how these will be administered.

5.3 Please note: The FSIDZ-LC merely acts as a facilitator between investors and service providers, and it does not guarantee work for any service provider (s) listed on its database.

6. CONFLICT OF INTEREST

6.1 The service providers on the panel may not in any way act inconsistent with his/her duties or expose him/herself to any situation involving the risk of a conflict of interest between the official responsibilities towards the investor and that of his/her private interests.

7. DISCLAIMER

7.1 The EODB unit reserves the right not to add to the panel any service provider who does not comply with the conditions of this TOR.

7.2 The EODB unit reserves the right to remove a service provider from the list should there be multiple complaints from investors on the quality and professional nature of the services provided.
